Welcome to Jimmarl Homes! These Terms of Service ("Terms") govern your access to and use of the Jimmarl Homes platform, including our website, mobile app, and services (collectively, the "Platform"). By using our Platform, you agree to comply with these Terms.
If you do not agree with these Terms, please do not use Jimmarl Homes.
1. Definitions
"Jimmarl Homes" – Refers to Jimmarl Homes, its affiliates, and subsidiaries.
"User" – Anyone who accesses or uses the Platform, including Hosts and Guests.
"Host" – A person or entity listing a property for short-term rental.
"Guest" – A person booking a property through Jimmarl Homes.
"Service" – The online booking, listing, and payment processing services offered by Jimmarl Homes.
2. Eligibility & Account Registration
2.1. You must be 18 years or older to use Jimmarl Homes.
2.2. You agree to provide accurate and complete information during account registration.
2.3. Jimmarl Homes may request identity verification for security and compliance.
3. Booking & Payments
3.1. Jimmarl Homes facilitates online bookings between Guests and Hosts.
3.2. Accepted payment methods: Visa, Mastercard, PayPal, M-Pesa, and bank transfers.
3.3. Booking: When a guest makes a booking through our platform, a contract is formed between the guest and the host for the rental of the property. Payment for bookings is processed through our platform. 10% of the payment shall be collected as a service fee. All payments are subjected to the terms and conditions of the third-party payment provider used by our platform.
3.4. Hosts receive payouts automatically after Guest check-in, subject to processing times.
3.5. Cancellation & Refunds: Refunds depend on the Host's cancellation policy and Jimmarl Homes' dispute resolution process.
4. Host & Guest Responsibilities
4.1 Host Responsibilities
Hosts must provide accurate property descriptions, pricing, and availability.
Hosts are responsible for complying with local short-term rental laws, permits, and tax regulations.
Hosts must ensure the property is safe, clean, and properly maintained.
4.2 Guest Responsibilities
Guests must respect Host rules and avoid property damage.
Guests are responsible for any damages they cause during their stay.
Guests must comply with local laws and refrain from illegal activities on the premises.
4.3 Property Listing Rules
4.3.1. Hosts are strictly prohibited from including any contact information (phone numbers, email addresses, social media handles, or external website links) in property descriptions, titles, or any other listing content.
4.3.2. Attempting to bypass the platform's communication system by sharing contact information may result in immediate account suspension or termination.
4.3.3. All communication between Hosts and Guests must be conducted through the Jimmarl Homes platform to ensure safety and security for all users.
4.3.4. Violation of these communication rules may result in:
- Immediate removal of the listing
- Temporary account suspension
- Permanent account termination for repeated violations
- Forfeiture of pending payments or fees
5. Compliance & Local Laws
5.1. Jimmarl Homes does not own or manage properties and is not responsible for legal compliance in different regions.
5.2. Hosts and Guests are responsible for understanding and following local short-term rental laws.
5.3. Jimmarl Homes may suspend or remove listings that violate legal or ethical standards.
6. Privacy & Data Protection
6.1. Jimmarl Homes collects, stores, and processes user data in accordance with our Privacy Policy.
6.2. We respect your privacy and are committed to protecting your personal information.
6.3. Users have the right to access, modify, or delete their personal data.
7. Dispute Resolution
7.1. Host-Guest Disputes: In the event of a dispute between a host and guest, both parties are encouraged to resolve the issue directly. If a resolution cannot be reached, Jimmarl homes may assist with mediation but is not liable for any damages or losses incurred.
7.2. Payment Disputes: Refund or chargeback disputes will be handled based on payment processor policies (e.g., PayPal, Visa, M-Pesa).
8. Termination & Account Suspension
8.1. Jimmarl Homes may suspend or terminate accounts for violations of these Terms.
8.2. Users may delete their account at any time, but outstanding obligations (e.g., unpaid fees, pending bookings) must be settled first.
9. Limitation of Liability
9.1. Jimmarl Homes is not liable for property damage, injuries, or legal violations by Hosts or Guests.
9.2. Jimmarl Homes does not guarantee uninterrupted service and is not responsible for technical errors or service outages.
10. Updates to These Terms
10.1. Jimmarl Homes may update these Terms at any time. Continued use of the Platform constitutes acceptance of any updates.
10.2. Users will be notified of material changes via email or in-app notifications.
